COMPLAINTS

In the unlikely event that you are not satisfied with the service the firm is providing or the amount of your bill, please contact the lawyer who is dealing with the matter, or their supervisor. If you are still not satisfied, please contact our client care Managing Director/Solicitor, Mr Edward Abenson, either by letter at 102 Allerton Road, Liverpool L18 1DG, or by email at abensone@abensons.co.uk or by telephone on 0151 733 3111.  Our client care Managing Director/Solicitor would provide you with a copy of our full complaints procedure.  If at the end of our investigation you are still not satisfied, then you could contact the Legal Ombudsman – PO Box 6806, Wolverhampton WV1 9WJ, or by telephone on 0300 555 0333, or by email to enquiries@legalombudsman.org.uk.  Our complaints procedure gives details of the categories of person/organisation that are entitled to complain to the Legal Ombudsman, relevant timescales and the possibility of the complaint being concluded by way of Alternative Dispute Resolution (ADR).

If you remain dissatisfied at the end of our complaints process, you would then be at liberty to contact the Legal Ombudsman, provided you are an individual, a personal representative of a deceased person, a “micro-enterprise” (having fewer than 10 employees and annual turnover or assets not exceeding 2 million Euros), a charity or club/association with annual income of less than £1 million, or a trustee of a trust with assets of less than £1 million. The Legal Ombudsman can investigate complaints up to six years from the date of the problem happening or within three years of when someone should have found out about the problem.   However, if we send a final written response to your complaint within 8 weeks of receiving it, the time limit for you to refer the matter to the Legal Ombudsman would be six months from the date of that final response.

Alternative complaints resolution bodies also exist and are competent to deal with complaints about legal services, should both you and our firm wish to use such a scheme at the end of our internal complaints process. They provide Alternative Dispute Resolution (ADR) services. Small Claims Mediation is one such body, details of which can be found at www.small-claims-mediation.co.uk ; and another is Ombudsman Services, details of which can be found at www.ombudsman-services.org .  Under the provisions of the EU Directive on Consumer Alternative Dispute Resolution, to pursue this process you would have to be a “consumer”, namely an individual acting for purposes which are wholly or mainly outside your trade, business, craft or profession.

The term “partner”,if used,denotes a Director or an employee or consultant with equivalent standing.

We ask that you read this privacy notice carefully as it contains important information on who we are, how and why we collect, store, use and share personal information, your rights in relation to your personal information and on how to contact us and supervisory authorities in the event that you have a complaint.

Who are we?

Abensons Law Limited t/a Abensons Solicitors collects, uses, and is responsible for certain personal information about you.  When we do so, we are regulated under the General Data Protection Regulations which applies across the European Union, including the United Kingdom and we are responsible as controller of that personal information for the purposes of those laws.

Personal data we collect about you

We have set out below the personal data that we may collect in the course of acting for you or advising you.

The personal data we will collect includes your name, address and telephone number, together with information to enable us to verify your identity and also electronic contact details.  We will also obtain information from you in relation to the instructions you have provided us with, and information to enable us to carry out credit or financial checks, and details of your financial status insofar as they relate to your instructions to us.

In addition we may also collect further data, depending upon the instructions you have provided to us, including banking details, National Insurance and Tax information, Social Media information, details of other family members, employment status and related financial employment information, Nationality and immigration status, pension details, racial/ethnic origins, gender and sexual orientation, religious or similar beliefs, full employment related records, medical records, Social Services records, Police records, financial information and memberships of any trade or associated Unions.

How do we collect your personal data?

We anticipate that most of this information will be provided by yourself, although we can obtain certain information from publicly available sources or from third parties, with your consent.  The information may also be collected from our own systems, if this information is already held or via our Website through the use of Cookies.

How do we use your personal data?

We would only use your personal information if  we have a proper reason for doing so which would normally be for the purpose of carrying out instructions which you have provided to us in order to undertake legal work on your behalf, to comply with legal or regulatory obligations and where you have given direct consent. We may have a business or commercial reason for using y our information, but we would only do so if this did not affect your own rights and interests.

Marketing and promotional offers

It is our intention to provide you with choices regarding personal data uses which relate to marketing and advertising.  We may use information that we hold to decide on what we think may be of interest to you or what you may need, and you may receive marketing communications from us if you have requested information or if we have previously provided legal services to you and as long as you have not opted out of receiving such marketing.  We will always get your express consent before we share any of your personal data with any company outside Abensons Law Limited.

Who we share your personal data with

We would regularly share your personal data with our professional regulators, including the Solicitor’s Regulation Authority and The Law Society, any professional advisers who we instruct on your behalf and this can include medical professionals, barristers, Tax advisers, accountants or any other experts.  Data will also likely be shared with H.M.Land Registry, Companies House, mortgage providers, insurers and brokers, Credit Reference Agencies, Lexcel, Conveyancing Quality Services and any other external auditors.  We may have to disclose information to regulatory bodies and various Law Enforcement Agencies to comply with our obligations, although we do satisfy ourselves that appropriate measures are in place to protect your personal data.

Data retention

Your personal data will be retained for as long as we consider it necessary to fulfil the purposes for which the data was obtained initially.  We will not retain data for longer than is necessary for the purpose of our policy.  When your file is closed, we will inform you of how long your data will be stored and before your file is sent for storage.  Please note that electronic data will be retained for longer than paper files.

We do not transfer your personal data outside the European Economic area.

Data security

We have in place relevant and appropriate security measures to prevent your personal data from being accidentally lost, used or accessed in an unauthorised way, altered or disclosed.  We limit access to your personal data to only those who have a genuine business need to access it and they will only process your personal data in accordance with our instructions and they are subject to a duty of confidentiality.  Procedures are in place to deal with any suspected personal data breach and we will notify you and any applicable regulator of a suspected data security breach where we are legally required to do so.

You have the right to be provided with a copy of your personal data, the right to require us to rectify any errors, the right to require us to delete in certain circumstances your personal data, the right to require us to restrict processing of personal data in certain circumstances, the right to receive personal data in a structured format in certain situations, the right to object to your data being processed for marketing purposes and in certain other situations to us processing your personal data and the right not to be subject to a decision based solely on automated processing which produces legal effects concerning you.  For more information you can access the guidance from the UK Information Commissioner’s Office on individuals rights under the General Data Protection Regulation.
