Our approach to commercial disputes is to enable both parties to resolve their differences at the earliest opportunity and consequently restrict costs. Beyond the specific issue, there is often a wider commercial relationship that needs to be considered. Abensons ethos is to seek a solution that not only satisfies both parties but also maintains and presumes where possible, the business relationship.

Any commercial dispute is time consuming and costly especially if it involves litigation. We adopt a number of methods designed to produce a swift and satisfactory outcome which include: -

  • Third party negotiations
  • Without prejudice meetings
  • Mediation, arbitration and adjudication
From time to time cases go to litigation. When that happens, we move quickly to trial and make the litigation process as stress-free and cost effective as possible.

Abensons have a hands-on and positive approach. Early intervention means that with careful and intelligent management of claims, it is often possible to resolve problems before there is significant disruption to the business or substantial legal costs are incurred.

As part of our service, we examine the causes of disputes and discuss with clients ways in which better risk management or changes to procedures could help prevent similar disputes in future.

The legal costs in pursuing commercial actions can often outweigh the sum in dispute. It is important to have both an initial and an on-going assessment of costs. We regularly update our clients on costs incurred against the original estimated cost so that the client remains in control of his case throughout.

The majority of cases are handled on the traditional hourly rate basis. We are happy to look at other arrangements including:

  • Conditional Fee Agreements (CFAs) involving no-win no fee
  • Fixed-fee appraisals for routine disputes.
