An injunction is an order of the Court that places restrictions on one person from actions against another. For example, it may forbid an ex-partner from pestering, harassing or intimidating their former partner, or from coming within a certain distance from the home. The aim is to solve your problems and protect you in the best way possible.Is an injunction only available if violence is involved?
Whilst many injunctions are taken out because of violence, it is clear that this is not the only form of abuse. For example, a partner may be telephoning at all hours of the day, or trying to make contact with you in other ways. All these things can be stopped by injunctions if they are causing genuine concern.How do I get an injunction and how long does it take?
When we have the details of your case will be able to draft an application (not order) to the Court. The whole process can take just a few days, and in the case of extreme emergencies, it could be completed in one day.What if the injunction is ignored?
If the person ignores the injunction against them, and continues in their behaviour, it is possible that the police will have the power to arrest them for breaching the Order. This is possible if the Court added a 'power of arrest' to the Order, which it often does in cases where there is evidence of violence in the past. It may be necessary to take the matter back to the Court to deal with any breaches of the injunction, and the Court does have the power to send the person to prison if there has been a serious breach or breaches.To discover more about the services available please contact :
